Pet Petal sells printed breed illustrations on suncatchers, canvas prints, ornaments, memorial pieces and home keepsakes. Artists, illustrators and photographers who love animals are exactly the people whose work we want to respect. If you believe something on petpetal.shop copies a work you own, this page tells you what to send, where to send it and what happens next. Copyright notices go to [email protected]. Trademark, logo and name concerns follow our separate Intellectual Property Policy.
Copyright notices in brief
- Email notices to [email protected] with the subject line “Copyright notice”.
- Name the original work, link the exact page on petpetal.shop, and include the sworn statements listed in section 3.
- We acknowledge your email within 24 hours on business days and act on complete, valid notices by removing or disabling the material.
- If a removal affects a customer’s own text, that customer may send a counter-notice.
- Pet Petal is a single store selling its own catalogue; there are no third-party sellers on the site.
1. What a notice can cover on this site
Everything you can see on petpetal.shop is in scope. In practice that means:
- Breed illustrations in Watercolor Style, Floral Wreath Style and Line Art Style, as they appear on product pages and in the live preview.
- Product photos and mockups, such as a suncatcher shown in a kitchen window or a canvas print shown above a sofa.
- Written content, including product descriptions, memorial verses offered in the verse select, and help pages.
- Customer-typed text that appears on a printed piece, such as a tagline or verse a customer entered into a personalisation field.
Our designs are illustrations of a breed, not reproductions of anyone’s photograph of their pet, and customers cannot upload photos to be printed. That narrows the ways a copyright problem can arise, but it does not rule one out, and we would rather hear about a concern than miss it.
2. Before you write to us
A few quick checks can save you time:
- Is it copyright or trademark? A copied drawing, photo or poem is copyright and belongs on this page. A brand name, team name, character name or logo is a trademark matter; please use the Intellectual Property Policy process instead.
- Is it a breed or a specific artwork? Copyright protects a particular drawing or photograph, not the idea of a golden retriever framed by peonies. If our watercolor golden retriever resembles yours only because both show the same breed in a popular style, it may not be a copy. If lines, composition or details match your work closely, please tell us.
- Is the page still live? Product pages can change. Copy the full address from your browser bar on the day you write, and take a screenshot.
3. What your notice needs to contain
The U.S. Digital Millennium Copyright Act (17 U.S.C. § 512) sets out what a valid notice includes. Please give us all six items:
- Your physical or electronic signature. A typed full name at the end of the email counts as an electronic signature.
- A description of the copyrighted work you say has been copied. If it is published online, add a link; if not, attach an image or describe it in enough detail for us to recognise it.
- The exact web address on petpetal.shop of each page where the material appears, and which part of the page you mean, for example “the line art cat on the round ceramic ornament, second image”.
- Your name, postal address and email address, so we can reach you and pass your details to the other party if a counter-notice follows.
- A statement that you believe in good faith that the use is not authorised by the copyright owner, its agent or the law.
- A statement that the information in your notice is accurate and, under penalty of perjury, that you are the owner of the copyright or authorised to act on the owner’s behalf.
Send it to [email protected]. Attachments such as images, links to your portfolio or registration certificates are welcome but not required. If something is missing, we will tell you which item so you can add it rather than start again.
| Item | Helpful example | Hard to act on |
|---|---|---|
| Your work | “My 2023 watercolor of a corgi with lavender, link to my portfolio page attached” | “One of my paintings” |
| Location on our site | The full product URL plus “the corgi design shown in the main image” | “Your website” |
| Authority | “I am the artist and sole owner” or “I represent the artist under a written agreement” | No statement about ownership |
| Signature | Your typed full legal name | A nickname or handle only |
4. What we do after a notice arrives
- Acknowledgement. We confirm receipt by email within 24 hours on business days.
- Review. We compare the notice with the page and the design files behind it. If an item is missing, we ask for it.
- Action. When a notice is complete and valid, we remove or disable access to the material. That might mean taking down a product page, replacing a mockup image or withdrawing a design from the breed list.
- Confirmation. We email you to say what was changed.
- Orders already placed. If customer orders are affected, we contact those customers directly and offer a different design or a refund. We do not share your details with them.
We do not ask you to prove anything beyond what the law requires, and we do not argue with a complete notice by email. If we believe there is an error, for instance that the design was licensed to us, we tell you plainly and explain what we hold.
5. Text a customer typed
Customers can type a pet’s name, years and a short tagline, and choose a verse from a list. Occasionally someone types the opening lines of a published poem or song into a tagline field. We cannot check every line against every book, so if you find that your words were printed on a piece, tell us with the details from section 3. We will stop that text being printed for future orders and, where an order has not yet been made, contact the customer to choose different wording. Verse options offered in our own select lists are written for Pet Petal or used with permission; if you believe one of them is yours, the same notice process applies.
6. If your text or order was affected: counter-notice
If material connected to you was removed and you believe that happened by mistake or misidentification, you can send a counter-notice to [email protected] with the subject “Copyright counter-notice”. It must include:
- Your physical or electronic signature.
- A description of what was removed and where it appeared before removal.
- A statement under penalty of perjury that you believe in good faith the material was removed because of a mistake or misidentification.
- Your name, postal address and email address.
- Your consent to the jurisdiction of the federal district court for your address, or, if you live outside the United States, for any judicial district in which Pet Petal may be found, and your agreement to accept service of process from the person who sent the original notice.
We send a copy of a complete counter-notice to the person who made the original claim. Under the DMCA, the material may be restored no sooner than 10 and no later than 14 business days after we receive the counter-notice, unless the claimant tells us first that they have filed a court action.
7. Honest notices only
Under 17 U.S.C. § 512(f), a person who knowingly misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages, including costs and attorney fees. Please do not use this process to remove designs you simply dislike or to pursue a dispute that is not about copyright. If you are unsure whether your rights are involved, independent legal advice is worth considering before you write.
8. Repeat problems
If the same customer account repeatedly submits text that infringes someone’s copyright, we may refuse further personalised orders from that account and close it. Where one of our own designs is found to infringe, we remove it from every product it appears on, not only the page named in the notice.
9. Notices from Canada, Australia and New Zealand
We sell to customers in the US, Canada, Australia and New Zealand. Rights holders in any of these countries can use the process above; the six items in section 3 give us what we need wherever you live. Our response follows the DMCA because the store is based in Nebraska, without affecting any right you have under the copyright law of your own country.
10. Wording you can adapt
You are welcome to write in your own words. If a starting point helps, the outline below covers every required item. Replace the parts in capitals inside round brackets with your own details.
- “I am (YOUR FULL NAME), the (ARTIST / PHOTOGRAPHER / AUTHORISED REPRESENTATIVE) of the work described below.”
- “The original work is (TITLE OR DESCRIPTION, YEAR), available at (LINK) or attached.”
- “The material I believe copies it appears at (FULL PETPETAL.SHOP URL), in (WHICH IMAGE OR DESIGN).”
- “I have a good-faith belief that this use is not authorised by the copyright owner, its agent or the law.”
- “The information in this notice is accurate, and under penalty of perjury I am the owner or am authorised to act for the owner.”
- “My postal address is (ADDRESS) and my email is (EMAIL). Signed, (TYPED FULL NAME), (DATE).”
11. Common questions about copyright and Pet Petal
Can I ask you to take down a design that shows my breed?
Only if the design copies your own drawing or photo. A breed on its own, such as a dachshund or a ragdoll cat, is not something anyone owns. Two artists can each draw a beagle in a floral wreath without copying each other.
I bought a Pet Petal ornament. Can I photograph it for my own post?
Yes. Sharing a photo of a piece you own, in your home or on your tree, is fine. Copying the illustration itself onto other products, or selling prints of it, is not. The Intellectual Property Policy explains what is allowed.
Someone else is selling a copy of a Pet Petal design. Should I use this page?
Thank you for telling us. Email the link to [email protected] with the subject “Copy of a Pet Petal design”. No sworn statement is needed from you, because in that case we are the rights holder and will follow it up ourselves.
Will the customer who ordered the piece see my name?
When a customer sends a counter-notice, the law expects the two parties to be able to reach each other, so we forward the notice to them. Otherwise, your details stay with us and are handled under our Privacy Policy.
Does a takedown affect a memorial piece someone already received?
No one is asked to give back a piece they already own because of a notice. A takedown stops the design being offered or printed again; a suncatcher already hanging in someone’s window stays where it is.
